IRCC’s Method for Employment Offer Verification

In order to assess an employment offer of a work permit applicant, IRCC assesses the following four aspects whether:

  • The employer issuing the job letter is “actively engaged” with the Business or not;
  • The job offer meets the appropriate needs of the employer or not;
  • The job offer has reasonable conditions that the employer can satisfy.
  • The job offer is issued by an employer or authorized recruiter who has previously demonstrated adherence to federal and provincial regulations for employment.

Besides this, IRCC has stated that the employer’s contact details must be included in the employment offer.

Let’s outline each in brief.

Assessing employee’s engagement with the Business

IRCC checks whether the organization providing jobs legally exists in Canada and whether it is capable of providing stable employment to the applicant. 

To evaluate this, the department checks whether:

  • The organization has a functional business;
  • The Business offers goods or services and
  • The Business has a physical location in Canada.

Besides this, the department also assesses the engagement of the employer in the Business. This is done by assessing:

  • the establishment date of the Business;
  • The kind of Business;
  • Total number of employees;
  • Gross income; and
  • Main activity.

Moreover, the IRCC officers will also execute a more detailed review:

  • Business information may raise concerns about business engagement, such as the Business being one year old; and/or
  • If limited business information is available through means like an internet search.

Does the employment offer satisfy the employer’s needs?

IRCC assesses whether the employment offer satisfies the employer’s need. The applicant’s job for which he is being hired should be fairly expected within the Business sector. 

Additionally, if IRCC contacts employers, they can specify and verify the business details effectively. For instance, about the job they are hiring for, and how the job will satisfy the employment needs and operations.

Does the employer satisfy the job offer terms?

Employers hiring employees must demonstrate that they can satisfy the terms mentioned in the job offer letter. This includes salaries, hours of work, and other benefits included. 

In addition, they must maintain the working conditions indicated in the job offer, which must also be in accordance with provincial and territorial standards.

If the reviewing IRCC officer demands additional information, they may request to check the legal and tax documents directly from the company. This may include a worker’s compensation clearance letter, business contracts, employer T4 slips, and more.

Does the employer follow employment and recruitment laws?

In addition to the above, IRCC also checks whether the adheres to the rules and regulations related to employment and recruitment both federally and provincially.

The officers may also consider any previous or current violation of Canadian laws during the assessment process.

Moreover, IRCC will also determine whether recruitment professionals (if involved in the process) involved in the hiring process were licensed at the time the offer was issued.

Employers who fail to cooperate with an IRCC request for the information may have their application denied.
